Unmet legal needs contribute to housing, income, and food insecurity, along with other conditions that harm health and drive health inequity. Addressing health injustice requires new tools for the next generations of lawyers, doctors, and other healthcare professionals. An interprofessional group of co-authors argue that law and medical schools and other university partners should develop and cultivate Academic Medical-Legal Partnerships (A-MLPs), which are uniquely positioned to leverage service, education, and research resources, to advance health justice.

Pittsburgh, PA: Mathesis Publications, 2001. Pp. x + 176. Paper, $25.00. Burnyeat's map is an ambitious attempt to establish two claims about Zeta: that Aristotle employs an unusual, non-linear form of argument in Zeta, and that the discussion in Zeta is on two levels, one abstract and "logical" and (...) another specific and "metaphysical." In addition to looking at Zeta, chapter by chapter, Burnyeat examines the other works that provide the context for Zeta—the Organon for the logical level of explanation and the rest of the Metaphysics for the metaphysical level. Burnyeat argues that Aristotle's metaphysical project culminates in the theology of'Lambda, for which the metaphysics of Zeta has prepared us. The goal is to "map" or sketch the evidence for these claims rather than provide definitive arguments for them.A brief introductory chapter presents the main themes of the book. This is followed by an even briefer chapter that sets out the four routes (or independent sections of Zeta), viz. Z 3; Z 4-6, 10-11 with Z 7-9, 12; Z 13-6; and Z 17 with H 1. On all four routes, a logical discussion moves to a metaphysical discussion of form and matter.The third chapter on "signposts" is the lengthiest of all and takes the reader through the chapters of Zeta in order. It is also the most map-like of the chapters, as it requires that the reader have a copy of the Metaphysics ready to hand. Burnyeat follows other commentators in treating Zeta 7-9 and Zeta 12 as later insertions; he does, however, argue that the former and probably the latter were added by Aristotle. Chapters 7-9 are integral to the argument of Zeta, as they provide a diachronic view of artifacts and substantial beings (37). [End Page 267] Rejecting the prominence assigned Z 13 by several recent commentators, Burnyeat reads Z 13 in context with chapters 14-6. "The task of Z 13-6 is to show how the idea that substantial being is a universal such as human leads eventually, after suitable refinements and restrictions, to the conclusion that substantial being is form" (54). Wrapping up the discussion of Zeta, Burnyeat concludes that the goal of Zeta's two-level approach has been to show how logical concepts should be used to search for form.This leads directly to a chapter on the Organon. Burnyeat argues that none of the treatises making up the Organon are metaphysical; all employ an abstract (logical) mode of analysis. Even if written at different times, these treatises belong together because they are all methodological. Since form and matter belong to the metaphysical level, in the Analytics Aristotle "follows a deliberate policy of excluding form and matter" (97).In the final chapter, Burnyeat returns to the Metaphysics and considers Zeta in the context of the other books. Three "chunks," viz. books ABGE, ZHQ, and MN are briefly surveyed. The topics of Zeta are then considered in relation to Lambda. Several chapters, viz. D1 and Z1; D3 and Z 7-9, are found to have the same concerns. Burnyeat concludes with a fanciful muqo~ (story) about a dying Aristotle hastily writing a culminating metaphysical treatise.Burnyeat gives us a map—a map to prompt questions; he does not attempt to delve into many of the interpretative puzzles that have exercised other interpreters of Zeta. Thus, this book stands as a helpful counterbalance to a certain kind of scholarship on Zeta. The two interpretative claims, however, that are at the heart of Burnyeat's enterprise stand in need of further justification. One of these, the non-linearity of Zeta, seems to be too weak to support substantive claims. Burnyeat defines non-linearity as holding when "it is not the case that the successive chapters build continuously upon the results of their predecessors" (4). As Helen Longino's overview of Hypatia's engagement with feminist epistemology suggests, the last twenty-five years’ contributions to this field reveal a strong focus on the topic of knowledge. In her short outline, Longino questions this narrow focus on knowledge in epistemological inquiry. The main purpose of this article is to provide a framework for systematically taking up the questions raised by Longino, one that prevents us from running the risk of becoming unreflectively involved in sexist, racist, or otherwise problematic inquiry. I argue that a specific form of the method of Reflective Equilibrium, as it is widely discussed in moral epistemology, logic, and theories of rationality, enables us to cope with the problems of traditional epistemology, which feminist theorizers such as Sally Haslanger have pointed to. With the account of Reflective Equilibrium I am offering—drawing in many respects on the model provided by Catherine Z. Elgin—we have an ameliorative method that allows us to rethink epistemological values, goals, and standards in a systematic way, and that largely avoids implicit and explicit biases in epistemology. ISBN 978-0-19-922697-9 John Cottingham, in a new collection of essays, asks the question: 'what exactly did Descartes himself chiefly take himself to be doing?' (254). 1 While the question is relatively clear, and while it acknowledges implicitly that Descartes was probably doing a range of different things, the answer that is apparently proposed here emerges only on reading the whole collection. Cottingham distinguishes in Chapter 1 - which is a new, synoptic overview of what is discussed in the other chapters, all of which were previously published - between two approaches to reading Descartes. One is to see him as 'a dummy on which to drape various suspect doctrines (such as “Cartesian dualism”)' (3), which contemporary analytic philosophers have shown to be radically mistaken. Another approach is adopted by historians of ideas 'who make it their life's work to pay meticulous scholarly attention to the philosophical works of past ages' (3). Cottingham does not explicitly criticize either of these approaches, but he hints at situating his own as some kind of Aristotelian middle course between the two. Since the two reference points are dangerously close to straw men or what Cottingham calls 'extreme positions', the proposed middle way may simply combine elements of two approaches, each of which is entirely legitimate. I return to this question at the conclusion. In fact, many of these essays were intended to show (rightly!) that Descartes never held the philosophical positions that are often attributed to him. The interpretation of Karol Wojtyla, later Pope John Paul II, provides a good example of how mistaken one can be: The Cogito ergo sum radically changed the way of doing philosophy … After Descartes, philosophy became a science of pure thought: all that is being- the created world, and even the Creator, is situated within the ambit of the Cogito, as contents of human consciousness. Philosophy is concerned with beings as contained in consciousness, and not as existing independently of it. (257) The only way to address such a caricature is to refer back to what Descartes actually wrote. Cottingham does precisely that, often quoting the original Latin or French texts. However, having shown successfully, by a close reading of the texts, that Descartes did not hold many of the views that are attributed to him, it still remains to say what Descartes did hold or teach about various philosophical problems that retain their perennial interest for us. This is how the question arises, intermittently, about what Descartes thought he was 'chiefly' doing, or what was his primary objective, in the course of an intellectual career that spanned three decades. However, the apparently legitimate desire to bring Descartes' intellectual endeavours into sharp focus may be frustrated by the evidence. His life and work manifestly lack the coherence or unity of purpose that one finds, for example, among many of his French or Dutch contemporaries. It is comparatively easy to 'read' the life of Gisbertus Voetius as that of an unwavering Calvinist theologian, to see Antoine Arnauld as a staunch and consistent theological defender of Port Royal, and even to interpret the obviously fragmentary contents of Pascal's unpublished notebooks (subsequently, the Penses) as an extended search for authentic religious faith, in opposition to what he perceived as the corruption of ecclesial structures. In contrast, Descartes' life reveals features that are difficult to integrate into a coherent pattern. He lived and published during a critical juncture in the Scientific Revolution of the seventeenth century. Although baptized into the Catholic Church soon after his birth in the Loire district of France, he chose to live most of his life in the aggressively Calvinist United Provinces, in which other religious practices were officially (though often ineffectively) banned. Descartes may have adopted the motto from Ovid, at least early in his career: 'bene vixit qui bene latuit' (he lives well who conceals himself well), and he seems genuinely to have wished to avoid theological controversies. However, he engaged in very public controversies with so many of his contemporaries - including Hobbes, Gassendi, the French Jesuits (collectively) and Father Dinet (in particular), Voetius and the University of Utrecht, Regius, Fermat, Roberval, Revius and other theologians at Leiden - that one might conclude that his claimed preference for a quiet life was a disingenuous mask. 2 Descartes published four books during his lifetime, and wrote at least one other that he had intended to publish. The latter was his first major composition, Le Monde, which he suppressed when he heard about Galileo's condemnation by Rome in 1633. This was followed, in 1637, by Descartes' first book (also written in French), which he tried to publish anonymously by withholding his name from the title page: the Discours de la methode pour bien conduire sa raison, & chercher la verit dans les sciences. Four years later Descartes published the first edition (in Latin) of Meditationes de prima philosophia, in quibus Dei existentia et animae immortalitas demonstrator, which also included six sets of objections and replies. The Principia philosophiae appeared (in Latin) in Amsterdam in 1644, and was followed five years later by Les Passions de l'Ame (in French). 3 In parallel with these publications, Descartes carried on a very extensive correspondence over a thirty-year period (in both Latin and French), and preserved copies or drafts of his letters with a view to future publication. Given the range and variety of his interests, and the sheer volume of writings, published or otherwise, that have survived from his pen, one may be tempted to engage in a comparative evaluation, as Cottingham does, by selecting one of Descartes' books as his primary contribution to philosophy. Cottingham claims that the Meditations was Descartes''masterpiece' (44), 'the definitive statement of Descartes's philosophy' (45) and the 'definitive statement of his metaphysics' (68). He also describes the Meditations more narrowly as 'his metaphysical masterpiece' (259, 303) and, more broadly, as 'his philosophical masterpiece' (289), and he lists it with the Discours as one of Descartes' two 'masterworks' (280). The Principia offers some competition in this comparative judgement when it is described as 'the canonical presentation of his metaphysical views' (114), while 'the construction of a moral system … was the crowning aim of his philosophy' (231). Having pitched repeatedly for the Meditations as Descartes' primary text, Cottingham claims that its author was 'a devout Catholic' (215), that he was 'a devoutly religious philosopher' (256), and that he could not free himself 'from the influence of the long years of theological study he had dutifully completed at La Flche' (62). Accordingly, the Meditations should be read as 'in essence a work of theodicy' (220); 'what has pride of place in the construction of his philosophical system is … an appeal to God … the nature and existence of the Deity is something that lies at the very heart of his entire philosophical system' (255). Without quite saying so, there are hints here that Descartes was a devout Christian whose primary intellectual contribution was to write a work of metaphysics, in which God is central and in the course of which the author alternates between proving God's existence and contemplating God - the latter a seventeenth-century version of Bonaventure's Journey of the Soul to God. 'Descartes's attraction to a contemplative mode of philosophizing' (305) is reflected, in the Meditations, in 'the language of the soul's coming to rest in adoring contemplation of the light' (306). Cottingham also accepts the overwhelming evidence from Descartes' correspondence that he 'devoted most of his career not to metaphysics but to science' (108), although he quibbles elsewhere with those who adopt the shorthand term 'science' to describe part of what was called 'natural philosophy' in the seventeenth century (282). He also refers to the '(notoriously lame) argument for the essential incorporeality of the thinking self' in one of Descartes' masterworks (60), and he describes the 'strange, seemingly isolated world of his metaphysical meditations' (139), with its 'creaking ontology' (147), when read in isolation from the rest of his work as a natural philosopher. How should we read him, then, in the twenty-first century? A Devout Catholic? That Descartes was a devout Catholic is possible, unlikely and undecidable. He seems not to have studied theology at all while at school at La Flche, although he completed the pre-theology college cycle in the company of Jesuit students who then continued their studies in theology. How and why, historian of science Lily Kay asks, did the ‘biological problem of DNA-based protein synthesis’ come to be represented ‘as an information code and a writing technology?’ What sort of metaphor was ‘code’ for these bio-geneticists? One whose run-away expansion, Derrida noted in Of Grammatology (1967), urgently required philosophical justification. Yet, 60 years later, there is still fundamental disagreement about its meaning and epistemic status. If the metaphor lacks ontological purchase, what accounts for its effectiveness? If, on the (...) other hand, scriptural metaphors get at the common root of culture and biology, what do we now mean by ‘code’? In this article, I trace several influential accounts of the metaphor’s effectiveness—making explicit the opposing notions of ‘code’ that animate them—and argue that each is too limited. The process of seeking the consent of a patient to a medical procedure is, arguably, one of the most important skills a doctor, or indeed any clinician, should learn. In fact, the very idea that doctors may institute diagnostic or treatment processes of any sort without a patient's consent is utterly counter-intuitive to the modern practice of medicine. It was not always thus, and even now it can be reliably assumed that consent is still not sought and gained appropriately in (...) every clinical encounter. To say that it should be sought and gained in this manner elevates the value of consent to a high level. It can be instructive to ask oneself why such a value might be held to be the case. The answer to this question lies in the philosophical underpinning of clinical consent, which sits within a notion of personal autonomy, and respect for autonomous decision making. (shrink)

O êxodo rural brasileiro compreendeu um processo de grande magnitude desde o seu início, onde, em comparativo, poucos países experimentaram fluxo migratório tão intenso, tendo em vista a quantidade absoluta da população atingida. Uma das características encontradas nos movimentos migratórios brasileiros se estabelece na diferenciação por sexo. Estudos apontam que as mulheres migram mais do que os homens, além do fluxo migratório se caracterizar cada vez mais pela saída de jovens do campo. Nesse sentido, o presente artigo se propõe a (...) analisar a categoria rural, abordando a situação das mulheres migrantes no contexto do Norte de Minas. Para tanto, utilizará do levantamento bibliográfico na construção de uma revisão acerca das práticas migratórias do campo realizadas por jovens, de modo a entender e problematizar a questão do gênero no processo migratório. Como resultado parcial tem-se que as mulheres continuam migrando, sendo tal deslocamento realizado com propósitos variados e, muitas vezes, devido à ausência de políticas públicas regionais, que resultam em pouca perspectiva de valorização do campo/gênero. Sendo assim, o processo migratório, principalmente no que diz respeito à questão de gênero, não se encerra nas discussões apresentadas, sendo necessários estudos que acompanhem as distintas dimensões que o migrar implica. Several philosophers argue for the ‘convergence thesis’ for positional goods: prioritarians, sufficientarians, and egalitarians may converge on favouring an equal (or not too unequal) distribution of goods that have positional aspects. I discuss some problems for this thesis when applied to two key goods for which it has been proposed: education and wealth. I show, however, that there is a variant of the thesis that avoids these problems. This version of the thesis is significant, I demonstrate, because it applies to (...) a person’s status as a citizen, which I suggest is the central concern of social or ‘relational’ egalitarianism. This paper examines the following distinctive republican claims: (1) goodwill and virtuous self-restraint are insufficient to realize freedom; and (2) suitable law is constitutive of freedom. In the contemporary literature, these claims are commonly defended in connection with the conception of freedom as nondomination. This account, however, is often rejected on the grounds that freedom as nondomination is moralized and impossible to realize. In response, I propose that the point of protecting people from domination is better understood not as realizing (...) freedom, but instead as giving persons a civic status as equals. Giving persons a civic status as equals, I claim, realizes an important form of social or 'relational' equality, and I distinguish this aim from giving persons a 'status as nondominated’, as some republicans require. I argue that this account vindicates alternative claims about the insufficiency of goodwill and constitutive importance of suitable law—understood in terms of equality rather than freedom—while avoiding the moralization and impossibility objections. I conclude by suggesting some further advantages of the proposed account versus the standard republican view. (shrink)

In the social sciences and in everyday speech we often talk about groups as if they behaved in the same way as individuals, thinking and acting as a singular being. We say for example that "Google intends to develop an automated car", "the U.S. Government believes that Syria has used chemical weapons on its people", or that "the NRA wants to protect the rights of gun owners". We also often ascribe legal and moral responsibility to groups. But could groups literally (...) intend things? Is there such a thing as a collective mind? If so, should groups be held morally responsible? Such questions are of vital importance to our understanding of the social world. In this lively, engaging introduction Deborah Tollefsen offers a careful survey of contemporary philosophers? answers to these questions, and argues for the unorthodox view that certain groups should, indeed, be treated as agents and deserve to be held morally accountable. Tollefsen explores the nature of belief, action and intention, and shows the reader how a belief in group agency can be reconciled with our understanding of individual agency and accountability. _Groups as Agents_ will be a vital resource for scholars as well as for students of philosophy and the social sciences encountering the topic for the first time. In recent years, a distinction between two concepts of equality has been much discussed: 'distributive’ equality involves people having equal amounts of a good such as welfare or resources, and ‘social’ or ‘relational’ equality involves the absence of social hierarchy and the presence of equal social relations. This contrast is commonly thought to have important implications for our understanding of the relationship between equality and justice. But the nature and significance of the distinction is far from clear. I examine several (...) accounts of this issue and argue none are entirely satisfactory. In turn, I offer an alternative proposal. Relational equality, on my account, involves a concern with each person having an equal 'civic status'. I characterize this concern and show it has distinctive and normatively significant positional and temporal aspects. (shrink)

Elisabeth's criticisms of Descartes's interactionism as well as her solution to the problem of mind-body interaction are examined in detail. The aim here is to develop a richer picture of Elisabeth as a philosophical thinker and to dispel the myth that she is simply a Cartesian muse.

Decades before the environmental movement emerged in the 1960s, Adorno condemned our destructive and self-destructive relationship to the natural world, warning of the catastrophe that may result if we continue to treat nature as an object that exists exclusively for our own benefit. "Adorno on Nature" presents the first detailed examination of the pivotal role of the idea of natural history in Adorno's work. A comparison of Adorno's concerns with those of key ecological theorists - social ecologist Murray Bookchin, ecofeminist (...) Carolyn Merchant, and deep ecologist Arne Naess - reveals how Adorno speaks directly to many of today's most pressing environmental issues. Ending with a discussion of the philosophical conundrum of unity in diversity, "Adorno on Nature" also explores how social solidarity can be promoted as a necessary means of confronting environmental problems. It was a time of expansive automation, biological discovery, rapid advances in medical knowledge, of animal trials and a questioning of the boundaries between species, human and non-human, between social classes, and of the assumed naturalness of political inequality. Normore document Descartes' attempt to make sense of the complex, composite objects of human and divine invention, consistent with the fundamental tenets of his metaphysical system. Their central argument is that, far from reducing all the categories of ordinary experience to the two basic categories of substance, mind and body, Descartes' philosophy recognises irreducible composites that resist reduction, and require their own distinctive modes of explanation. What is the relationship between fear, danger, and the law? Cass Sunstein attacks the increasingly influential Precautionary Principle - the idea that regulators should take steps to protect against potential harms, even if causal chains are uncertain and even if we do not know that harms are likely to come to fruition. Focusing on such problems as global warming, terrorism, DDT, and genetic engineering, Professor Sunstein argues that the Precautionary Principle is incoherent. Risks exist on all sides of social (...) situations, and precautionary steps create dangers of their own. Diverse cultures focus on very different risks, often because social influences and peer pressures accentuate some fears and reduce others. Instead of adopting the Precautionary Principle, Professor Sunstein argues for three steps: a narrow Anti-Catastrophe Principle, designed for the most serious risks; close attention to costs and benefits; and an approach called 'libertarian paternalism', designed to respect freedom of choice while also moving people in directions that will make their lives go better. He also shows how free societies can protect liberty amidst fears about terrorism and national security. Has the diversity of corporate boards of directors improved? Should it? What role does diversity play in reducing corporate wrongdoing? Will diversity result in a more focused board of directors or more board autonomy? Examining the state of Tennessee as a case study, the authors collected data on the board composition of publicly traded corporations and compared those data to an original study conducted in 1995. Data indicate only a modest improvement in board diversity. This article discusses reasons for the (...) scarcity of women on boards and concludes that, to enhance strategic decisions, board membership should reflect the corporation''s consumer population. Thus, women are a critical but overlooked resource. Areas for future research are also considered. (shrink)

This article investigates whether or not theories of justice from political philosophy, first, support the position that health research should contribute to justice in global health, and second, provide guidance about what is owed by international clinical research (ICR) actors to parties in low- and middle-income countries. Four theories—John Rawls's theory of justice, the rights-based cosmopolitan theories of Thomas Pogge and Henry Shue, and Jennifer Ruger's health capability paradigm—are evaluated. The article shows that three of the four theories require the (...) conduct of health research for justice in global health. The theories help identify the ends of justice to which ICR is to contribute, but they cannot tell us how to organize ICR to promote these ends. Aside from Ruger's health capability paradigm, the theories also lack an allocative principle for assigning specific duties to specific actors. This creates difficulties for establishing obligations for certain types of ICR actors. (shrink)

Numerous philosophical theories of joint agency and its intentional structure have been developed in the past few decades. These theories have offered accounts of joint agency that appeal to higher-level states that are?shared? in some way. These accounts have enhanced our understanding of joint agency, yet there are a number of lower-level cognitive phenomena involved in joint action that philosophers rarely acknowledge. In particular, empirical research in cognitive science has revealed that when individuals engage in a joint activity such as (...) conversation or joint problem solving, they become aligned at multiple levels. We argue that this phenomenon of alignment is crucial to understanding joint actions and should be integrated with philosophical approaches. In this paper, we sketch a possible integration, and draw out its implications for understanding of joint agency and collective intentionality. The result is a process-based, dynamic account of joint action that integrates both low-level and high-level states, and seeks to capture the separate processes of how a joint action is initiated and sustained. Autism is one of the most compelling, controversial, and heartbreaking cognitive disorders. It presents unique philosophical challenges as well, raising intriguing questions in philosophy of mind, cognitive science, and philosophy of language that need to be explored if the autistic population is to be responsibly served. John Rawls’s thesis that a certain package of basic liberties should be given lexical priority is of great interest for legal and political philosophy, but it has received relatively little defense from Rawls or his supporters. In this paper, I examine three arguments for the thesis: the first is based on the two ‘moral powers’; the second, on the social bases of self-respect; and the third, on a Kantian notion of autonomy. I argue none of these accounts successfully establishes 1) (...) the distinct claim of lexical priority, 2) for the complete package of basic liberties, on the basis of reasons that are appropriately public. In turn, I propose an alternative argument, in support of those two claims, based on the social or ‘relational’ conception of equality. (shrink)
